The Information Commissioner's Office (ICO) has been working on replacing its "Detailed Cookies and Similar Technologies Guidance" with new "Storage and Access Guidance". This significant revision could provide much needed clarity in a complex landscape for data-driven marketers and Data Protection Officers (DPOs).

This updated guidance is designed for providers of online services, including web and app developers. It offers a deeper understanding of how the Privacy and Electronic Communications Regulations (PECR), alongside relevant data protection law, apply to storage and access technologies.

PECR covers a wide range of technologies, including cookies, tracking pixels, link decoration and navigational tracking, local storage, device fingerprinting, and scripts and tags.

To enhance regulatory clarity, the guidance now uses "must," "should," and "could" language, helping readers better understand compliance requirements. It also reflects recent case law and the ICO's positions on key topics, including their expectations for online advertising.

The ICO's New Consent or Pay Model Guidance

The ICO has also issued its first-ever guidance on Consent or Pay models. This new clarification confirms that such models are legal in the UK, providing much-needed clarity for publishers and organisations relying on digital revenue models.

It confirms that businesses can lawfully offer users the choice between:

  1. Consenting to data use for personalised advertising, or
  2. Paying for an ad-free experience.
