How can you stay up-to-speed with legal reform and keep your marketing compliant?
The ICO has been working on replacing its Detailed Cookies and Similar Technologies Guidance with its Storage and Access Guidance. This updated guidance represents a significant revision which could provide much needed clarity in a very complex landscape for data driven marketers and DPOs. This guidance is designed for providers of online services, including web and app developers, who require a deeper understanding of how the Privacy and Electronic Communications Regulations (PECR) and, where relevant, data protection law apply to storage and access technologies. PECR covers a range of technologies, including but not limited to cookies, tracking pixels, link decoration and navigational tracking, local storage, device fingerprinting, and scripts and tags. To enhance regulatory clarity, the guidance has been rewritten using "must," "should," or "could" language, helping readers better understand compliance requirements. Additionally, it reflects recent case law and the ICO's positions on key topics, including expectations for online advertising.
The ICO have also issued their first ever guidance on Consent or Pay models. The new guidance clarifies that 'Consent or Pay' models are legal in the UK. This guidance provides much-needed clarity for publishers and organisations relying on digital revenue models, confirming that businesses can lawfully offer users a choice between consenting to data use for personalised advertising or paying for an ad-free experience.
Join an in-depth exploration of what the new guidance means for members chaired by Chris Combemale. Hear the ICO team responsible for both pieces of guidance explain them while the DMA team takes you through our consultation responses and a member of the Governance Committee explains the implications for social media plug-ins.
You will the opportunity to have all your questions answered during an in-depth Q&A panel discussion including the main three speakers who will be joined by a panellist from the PPA or NMA to discuss the implications for media owners and advertisers.
This a recurring event designed to keep our DMA Member community informed and updated.
