ICO
No enforcement actions in our area from the ICO since last time, but you may have heard the sound of Subject Access Request (SAR) procedures being ripped up across the country as the ICO quietly reduced the window to respond to SARs by one day.
And to show that this stuff matters Hudson Bay Finance Limited has had its knuckles rapped by the ICO for not responding to a SAR request – and ignoring the ICO’s enquiries, too…
The ICO is expected to issue its proposed new, post-GDPR Direct Marketing Guidance replacing this shortly, too.
TPS
As discussed at the last Council meeting the DMA has won the ICO’s tender to continue operating the TPS for another 3 (and potentially 5) years.
Payments
It’s ‘panic over’ for plenty of organisations taking and processing online payments after the FCA formally confirmed an 18 month phasing-in period for the Strong Customer Authentication (SCA) rules, part of the EU’s 2nd Payment Services Directive (PSD2), rather than sticking to the original ‘big bang’ date of 14th September.
NB Different European regulators have adopted different approaches to this – but if you’re part of an organisation with operations across Europe you probably have bigger things to worry about just now.
Nothing much from Ofcom over the past few weeks, aside from a press release reminding consumers that some of the oldest scams and still the most successful.
As you know, directors of firms which don’t pay their ICO fines can now be struck off. There was a case a couple of weeks ago with a 5-year ban from acting as a company director for Jonathon De Sousa who ran Glasgow-based Xternal Property Renovations Ltd which was fined – but didn’t pay - £80,000 for calling TPS numbers in contravention of the PECR rules.
Again, it’s been a quiet month for both the PSA and the Fundraising Regulator
