Very useful article Ben. To add some further detail, I was at an event this week where one of the barristers in the case was on a panel with the Commission's Head of Data Protection, and the Assistant European Data Protection Supervisor, plus someone from the ICO. I asked in relation to this case, how they expect the GDPR to handle this question of browser generated information. The universal response was the expectation that the new Regulation will confirm the position that this will be included in the definition of personal data. It seems this is almost inevitable now and therefore organisations need to start preparing for this eventuality.
