The Government has just launched a consultation on proposed changes to the fees payable by data controllers to the Information Commissioner’s Office (ICO). The consultation can be found here.
The consultation is informed by a statutory review of the Data Protection (Charges and Information) Regulations 2A018, conducted in 2023. The consultation is seeking views on proposals to increase the current fees, which have not been raised since 2018 when the fee regime was introduced. The proposals aim to provide the ICO with the financial resources required to fulfil their functions under data protection legislation, including the provision of guidance, advice and support to organisations to support compliance with data protection obligations and to achieve full cost recovery in line with HM Treasury’s principles on Managing Public Money.
